Nothing is more painful than suddenly losing a spouse, child, or parent due to someone else’s negligence or misconduct. In Pennsylvania, the personal representative of the victim’s estate must file a wrongful death lawsuit. If the personal representative does not do so within six months of the victim’s death, then the victim’s spouse, children, and/or parents can file suit. They are the only relatives who can collect damages under Pennsylvania’s wrongful death statute. Minors may require an adult guardian to file suit on their behalf.
